Select your sector. Evaluate 8 sector-specific risk factors against DPDPA obligations. See your exposure in real time.
DPDPA risk is a function of data volume and sensitivity, the number of Data Processors, likely Significant Data Fiduciary status under Section 10, the maturity of consent and notice, and breach-response readiness. The higher these factors, the greater the exposure to the Schedule penalties β up to βΉ250 crore for security failures and βΉ200 crore for children's-data failures.
The Schedule to the Act lists graded maximums, the highest being βΉ250 crore for failure to take reasonable security safeguards. The Data Protection Board sets the actual penalty on the nature, gravity and duration of the breach β so documented, demonstrable compliance directly reduces financial risk.
Under the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025: notice β Section 5 read with Rule 3; consent β Section 6, with Consent Managers under Rule 4; reasonable security safeguards β Section 8(5) and Rule 6; personal data breach intimation β Section 8(6) and Rule 7; erasure β Section 8(7) and Rule 8; children's data β Section 9 and Rule 10; Significant Data Fiduciaries β Section 10 and Rule 13; Data Principal rights β Sections 11 to 14 and Rule 14; transfer outside India β Section 16 and Rule 15; penalties β Section 33 and the Schedule.
